Terms and Conditions 2011
1 The Owners, Jonathan and Cheryl Rome, offer the property,
as described in the property details for holiday rental, subject to written
confirmation, to the client. The letting contract is between the Client and the
Owners.
2 The description of the Property is given in all good
faith. It is the responsibility of the Client to establish the suitability of
the Property for his/her party’s needs and to ask for any information that
he/she deems relevant prior to making a booking.
3 To reserve the Property, the client should contact the
Owners by telephone or e-mail and pay a non-refundable deposit of 50% of
the total booking amount. Following clearance of the deposit, written
confirmation of the booking, a receipt and full details in order to find
the Property will be sent to the Client.
4 The balance of the rental is payable not less than twelve
weeks before the start of the rental period. If payment is not received by
the due date, we reserve the right to give written notice that the reservation
is cancelled. The Client will remain liable for the
balance of the rental unless we are able to re-let the
Property. Reservations made within twelve weeks of the start of the rental period require
full payment at the time of booking.
5 Any chargeable expenses arising during the rental period
(e.g. cleaning supplement or heating costs in excess of 20 euros) should be
settled locally with the Owner before departure.
6 A Security Deposit of 150 euros per week is required to
cover possible damage to the Property or its contents or in the event of the Property not
being thoroughly cleaned prior to departure. The sum mentioned does not however
limit the Client’s liability to the Owner in the event of greater damage to the
Property or its contents. The Owner will account to the Client for the Security
Deposit and refund any money due within two weeks of the end of the rental
period.
7 The Client agrees to take out comprehensive travel
insurance giving full personal liability to all members of the party since
under French law, this is not covered by the Owner’s insurance policy.
Documentary proof of this cover needs to be provided before the start of
the rental period. In the event of cancellation, the deposit of 50% is
non-refundable and as stated in point 4 the Client remains liable for the
balance. It is the Client’s responsibility to check that suitable cancellation
insurance is included in the travel insurance policy taken.
8 The rental period begins at 5.00pm (local time) on the
first day of the rental period and ends at 10.00am (local time) on the last
day. Late arrival times must be agreed at least 48 hours in advance.
The Owner is not obliged to offer the accommodation before 5.00pm on the
day of arrival nor does the Client have any entitlement to occupy the property
after 10.00am on the day of departure.
9 The maximum number of guests to reside in the property
must not exceed the stated capacity. Any modification to client numbers after booking must be
notified to the owner before arrival.
10 The Client agrees to be a considerate tenant, to take
good care of the Property and all associated facilities and to ensure that no
one in the party acts in any way which could cause disturbance to
neighbouring properties or cause risk of damage or injury and to adhere
to any internal rules and regulation present at the Property. The
Client agrees to leave the Property in a clean and tidy condition at the end of the rental
period. The Owner reserves the right to retain all or part of the Security
Deposit to cover costs if the Client has left the Property in an
unacceptable condition. The Owners are the sole judges in this matter.
11 The Client must allow the Owners to enter the Property
to inspect it or carry out any maintenance by prior appointment. In the
event of any emergency, the Client must grant immediate access to the
Owners or any necessary rescue services/contractors.
12 The Client shall report to the Owners without delay, any
defects or shortcomings in the Property, or breakdown of equipment or
appliances in order that remedial action can be taken as soon as
possible.
13 Under no circumstances must any item of a combustible
nature be allowed within the Property or garden. This includes candles
and incense sticks. Smoking is permitted in the garden only – for the
comfort of others it is not allowed within the Property.
14 The Owners shall not be liable to the Client:
-for any temporary defect or stoppage in the supply of
public services to the property, nor in respect of any equipment, machinery
or appliance in the Property, garden and associated facilities
-for any loss, damage or injury that is the result of
weather condition, riots, wars, strikes or any other matter beyond the Owners'
control
-for any noise or inconvenience caused by nearby
building/construction work as such work is completely outside of the Owners'
control. The Owners receive no advance warning of dates when this may occur.
-for any loss, damage or inconvenience caused to or
suffered by the Client if the Property is destroyed or substantially damaged
before the start of the rental period. In any such event, the liability of
the Owner shall not exceed any amount paid by the Client to the Owner.
The Owner will notify the Client and refund any amount already paid in
the event of the Property being substantially damaged or destroyed before
the holiday period.
